1. Responsibilities of the Criminal Record Departments of the Central Service of the Ministry of Justice

According to the provisions of Presidential Decree 30/2025 “Organization of the Ministry of Justice” (Government Gazette A’ 52), the responsibilities of the Criminal Record Departments of the Central Service are defined as follows:

A’ Criminal Record Department (Issuance Department)

The Department is responsible for:

  • maintaining criminal record archives for persons born abroad or whose place of birth is unknown or cannot be determined, issuing and providing Criminal Record Copies in accordance with the relevant provisions of the Code of Criminal Procedure, and
  • ensuring the continuous upgrading of criminal record services provided to citizens, judicial and prosecutorial authorities, public services and other entities.

B’ Criminal Record Department (International Cooperation Department)

The Department is responsible for:

  • the exchange of criminal record information, acting as the Central Authority within the framework of the European Criminal Records Information System (ECRIS, ECRIS-TCN), and
  • fulfilling obligations arising from the implementation of international conventions or relating to the establishment and implementation of judicial assistance rules on criminal record matters and related functions.

2. Responsibilities of the Criminal Record Departments of the Public Prosecutors’ Offices of First Instance throughout the Country

The responsibilities of the Criminal Record Departments of the Public Prosecutors’ Offices of First Instance throughout the country include in particular:

  1. electronic maintenance, validation, destruction and replacement of Criminal Record files
  2. receiving applications for the issuance of Criminal Record Copies, examining and issuing them
  3. checking criminal status records for all Courts, Investigating Judges and Detention Facilities
  4. monitoring modifications, forwarding Criminal Record Copies to various judicial and other authorities, and deleting Criminal Record files following annulment, appeal, cancellation or retrial procedures
  5. receiving applications regarding disputes/corrections of erroneous entries and issuing Orders by the competent Public Prosecutor for the deletion of penalties from the Criminal Record
  6. verifying the authenticity of Criminal Record Copies.
